Occupational Safety, Health and Working Conditions Code, 2020, Comes into Force

The Central Government, through a notification issued by the Ministry of Labour and Employment, has officially brought the Occupational Safety, Health and Working Conditions Code, 2020 (Act 37 of 2020), into effect. This significant development was formalized by Notification S.O. 5321(E), published in the Gazette of India on November 21, 2025. The notification specified that the provisions of the comprehensive Code would come into force on the very day of its publication, November 21, 2025. This action operationalizes a key piece of legislation that was enacted by Parliament in 2020, marking a pivotal moment for labour law reforms concerning workplace safety and health across the country. The issuance of this notification was carried out in exercise of the powers conferred upon the Central Government by sub-section (2) of section 1 of the Occupational Safety, Health and Working Conditions Code, 2020, which empowers it to appoint the date of commencement. Consequently, all establishments, employers, and workers falling under the purview of this Code are now subject to its provisions, which aim to standardize and enhance safety and health standards in various sectors.

The legislative intent behind the Occupational Safety, Health and Working Conditions Code, 2020, and subsequently, its commencement through this notification, is to consolidate and amend the laws regulating occupational safety, health, and working conditions of persons employed in establishments. Prior to this Code, the legal framework governing these aspects was fragmented across numerous statutes, leading to complexities in compliance and enforcement. The Code was designed to address these statutory gaps and limitations by providing a unified and more robust legal framework. It seeks to ensure safer workplaces, better health provisions, and improved working conditions for a vast segment of the Indian workforce. The legislation provided: “...the Central Government hereby appoints the 21st day of November, 2025 as the date on which the provisions of the said Code, shall come into force.” This formal commencement means that the new rights and obligations stipulated within the Code, pertaining to duties of employers and employees, registration of establishments, working hours, leave, and other welfare measures, are now legally enforceable. The Code also introduces mechanisms for inspections, penalties for non-compliance, and provisions for the safety and health of specific categories of workers, thereby replacing and streamlining the provisions of thirteen older central labour laws. Its activation is expected to have a far-reaching impact on industrial relations and workplace governance, promoting a more secure and healthy environment for workers nationwide.
